Mediation

Mediation is an alternative to going to court to resolve domestic relations disputes including divorce, paternity, child support, custody, and parenting time. Mediation is a confidential process by which the parties, and their attorneys, meet with a mediator who acts as a neutral third party, in an attempt to resolve the pending legal issues. The mediator works with the parties, to develop alternative and unique solutions to the issues presented, and to help the parties address their concerns as opposed to their positions.

Mediation is often helpful in many cases such as family law, business, and probate and trust disputes as it allows the parties an opportunity to come to a customized mutually beneficial agreement, while maintaining control over the terms and wording of their agreements. Mediation provides a safe environment for the parties to try to resolve the pending issues without forfeiting their right to litigate the issue if mediation does not result in an agreement. If mediation does result in an agreement, the agreement is submitted to the Court for approval. Once approved by the Court, a mediated agreement becomes a binding Court order that is enforceable. Mediation is less confrontational than Court as the parties are in separate rooms as all communication goes through the mediator. This can help reduce stress and conflict to some degree.
